Our Senior Solicitor, Sally Denton, appeared on Notts TV’s Ey Up Notts on Monday 26 November. 

Sally spoke with Nicola Beswick about housing, possession proceedings and the steps landlords must take in order to legally evict a tenant. 

Sally stressed the importance of attending court if you are facing possession proceedings as there will always be someone there who can help. 

Sally talked about the Housing Possession Court Duty Scheme at Nottingham County Court, which is run by the Law Centre, whereby anyone at risk of losing their home can turn up on the day of their hearing and be represented free of charge.

Sally explained that even though it is vital that you attend court on the day of your hearing the earlier you can seek advice the better. This will give your adviser more time to prepare for your case and make any necessary enquiries prior to the hearing.

Nottingham Law Centre has assisted a number of clients in the last few months who have been evicted illegally. 

The charity has even had some cases where landlords have evicted tenants by text message. 

Sally took the opportunity to remind everyone that a landlord needs to obtain a court order in order to take possession of the property, any other method is illegal.

At this time of year, in the run-up to Christmas and with events like Black Friday and Cyber Monday dominating the media, it can be easy to forget about some of the most vulnerable people in society, people who may be homeless at Christmas as they have been illegally evicted or who could have kept their homes with a little bit of help.
